KevMaverick wrote:As an extra point to this - I've just been doing some searching on Youtube. There are many record companies that post official videos on the site - aren't they worried about people copying the music? It is an easy thing to do, and their videos have very high quality sound - just the thing that people who rip off music love...
Also, there are many people posting their own cover versions of songs, and this is clearly in breach of copyright!
So why do DJ's, using just a few minutes of each song, get penalised?
I am absolutely with you Kevin when you say that a mix on youtube is a good promotion of a track - aabsolutely true, nothing to day against it!
Getting back to your quote here: The record companies want to control the market and therefore they flag any track of them or any mix with tracks of them it to delete any material which you can find on their youtube channel. Why is that? Well if i.e. Warner or Sony are the only one which host the video you have to go to their channel and it is controlled by them! They can offer different other stuff and make people buying stuff they will not buy if they hear the track in cross_fade's set.
You said that it is like buying a car but not being allowed to drive it. Exactly! That is it! I was contacting Beatport to clarify that and here is their answer:

Thanks for getting in touch with us.
The answer is yes, but this can depend on territory restrictions. In the United States and UK, the Answer is YES, buying a track from Beatport is just like buying a record from the record store. The same legal implications are in effect. However, certain Territories have different restrictions regarding the legality of playing Digital Music files. But normally if you show to the authorities the printed copy of your receipts you should not have problems. We suggest you visit the website of your local publishing / mechanicals service to get a more detailed answer. We also recommend that you keep a copy of your order receipts with your music to prove that you have purchased your music legally. Beatport has taken the time to create agreements with all labels involved with our site and provide you with digital, legal alternatives to the music you may have purchased on record previously.
You should not perform any of the music without consent and permission from the owner of the rights, either through clubs or for hold music, but chances of getting in trouble for either of those is very very slim if not none, however the decision to play the music or broadcast it is entirely up to the person. It's a legality, similar to people putting "caution, may cause drowsiness" on sleeping tablets.
If you have any further queries don't hesitate to contact us again.
Cheers,
Speaking for Germany it is absolutely prohibited to play music in public unless you pay a fee to the GEMA. On several gigs I had to fill out a paper with my playlist so that the club owner could send it to the GEMA and that they knew what he has to pay for the evening! Over here it depends how high this fee is. It varies from how huge the area is, how many people were/will be there and so on. So yes, Germany is the worst country for playing music in public. Listening to Beatport they say that it is different and easier in the US and UK, so guys be happy that you are living there. Over here it is a pain in the ass!
Last but not least: Being able to copy music from youtube is not promotion and no one gets money from that, so this is not the commercial thing they are talking about. It is youtube that gets the money while people are clicking and watching your set online.
A while back I was writing a mail to soundcloud because I wanted to know why they are offering their service, because this is absolutely illegal. They do the same as cross_fade! Surprisingly no one answered and I guess that this is the answer: they know it is illegal, calculated with it and if someone is bringing them to court they have the money for paying their penalty - easy business and easy earned money. It works until someone gets awake!
That's it for now, a lot to read, but this is important!
